PPS 14, Draft Magherafelt Area Plan & Draft Northern Area Plan – UNLAWFUL!
We are delighted to advise you that the High Court today ruled that PPS 14, the draft Magherafelt Area Plan and the draft Northern Area Plan are all unlawful. In other words, all three major policy publications have been scrapped.
Elevate Planning Consultants have been lobbying against these flawed policies for some years now. We met Senior Planning Officials, Government Ministers and ultimately the Judiciary in our efforts to persuade the powers that be that they were moving in the wrong direction. Our consultancy questioned the policy’s compliance with European Legislation specifically regarding the Strategic Environmental Assessment , the Department’s ability to act as ‘judge & jury’ in that they prepared the plan and also acted as consultees and the Plan’s ability to engage proper & effective public consultation, amongst other arguments. The respective Judges ruled in favour of our view.
It may be some time before the fallout from these monumental decisions is known, but in the meantime any decisions to be taken by The Planning Service must be based on the former rural planning strategy, and on the old area plans in respect of the council districts of Magherafelt, Limavady, Coleraine, Ballymoney and Moyle.
Elevate Planning will be on hand to offer some more considered advice to each of our clients individually, specific to each potential development site, during the coming weeks. If you have a particular query please contact our planning staff on 02890 242 486. Alternatively, please email us at info@elevateplanning.co.uk. We would be delighted to offer assistance and advice.
